Terms of Service

1. Acceptance of Terms

By accessing or using Kallos AI (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

2. Service Description

Kallos AI is an AI-powered marketing automation platform that provides:

• AI-generated content (blog posts, social media posts) using OpenAI GPT-4 and Anthropic Claude
• Performance analytics from Google Analytics 4 and social media platforms
• Intelligence gathering (competitor monitoring, Google Trends, social listening)
• Automated content scheduling and multi-platform publishing
• Brand voice training and content refinement

3. Account Registration

To use the Service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be at least 18 years old or have parental/guardian consent
• Not create multiple accounts or share your account with others

4. Acceptable Use

You agree NOT to use the Service to:

• Generate content that violates laws or infringes intellectual property rights
• Create spam, misleading, or fraudulent content
• Distribute malware, viruses, or harmful code
• Attempt to reverse engineer, hack, or circumvent security measures
• Scrape, crawl, or extract data from the Service using automated means
• Resell, sublicense, or redistribute the Service without authorization

5. Subscription & Billing

5.1 Subscription Tiers

• Free Tier: 2 blog posts/month, 5 social posts/month
• Creator Tier ($29/month): 100 AI-generated posts/month, 3 social channels, basic analytics
• Business Tier ($79/month): 500 AI-generated posts/month, all social channels + WordPress, advanced analytics
• Agency Tier ($199/month): Unlimited AI-generated posts, all channels, team collaboration

5.2 Billing

• Subscriptions renew automatically each month unless cancelled
• You will be charged on the same day each month (billing cycle reset)
• No refunds for partial months or unused content limits
• We reserve the right to change pricing with 30 days notice

5.3 Cancellation

You may cancel your subscription at any time via Settings → Billing. Cancellation takes effect at the end of the current billing period. No prorated refunds are provided.

6. Usage Limits & Fair Use

To ensure fair access for all users, we enforce the following limits:

• Content generation limits based on subscription tier (reset monthly)
• API rate limits: 10 requests/minute per user
• AI image generation: 25 images/day per brand
• Data export: 1 export per 24 hours

Exceeding these limits may result in temporary throttling or account suspension.

7. Intellectual Property

7.1 Your Content

You retain ownership of all content you create using the Service (blog posts, social posts, images). We do not claim ownership of your content.

7.2 Our Platform

The Service, including its design, code, algorithms, and branding, is owned by Kallos AI and protected by copyright, trademark, and other intellectual property laws.

7.3 AI-Generated Content

Content generated by AI (OpenAI GPT-4, Anthropic Claude) is licensed to you for commercial use. You are responsible for ensuring the content does not infringe third-party rights. We provide a confidence score to help you assess content quality.

8. Third-Party Services

The Service integrates with third-party platforms (WordPress, LinkedIn, Facebook, Twitter, Google Analytics 4). You are responsible for:

• Complying with the terms of service of these third-party platforms
• Ensuring you have authorization to connect these platforms to our Service
• Managing your OAuth tokens and revoking access when necessary

We are not responsible for issues caused by third-party platform changes, outages, or policy violations.

9. Data & Privacy

Our collection, use, and protection of your data is governed by our Privacy Policy. Key points:

• We comply with GDPR, CCPA, and other privacy regulations
• You can export your data at any time (Settings → Account)
• You can delete your account with 30-day retention period
• Platform OAuth tokens are encrypted and never shared with third parties

10. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may:

• Perform scheduled maintenance with advance notice
• Experience downtime due to third-party dependencies
• Suspend the Service for security, legal, or operational reasons

We are not liable for losses caused by service interruptions.

11. Disclaimers & Limitation of Liability

The Service is provided “AS IS” without warranties of any kind, either express or implied, including but not limited to:

• Accuracy of AI-Generated Content: We do not guarantee that AI-generated content is accurate, original, or free from errors. You are responsible for reviewing and editing content before publishing.
• Performance Metrics: Analytics data is fetched from third-party APIs. We are not responsible for inaccuracies in Google Analytics 4 or social media platform data.
• Platform Publishing: We are not liable for failed publishes, content formatting issues, or policy violations on third-party platforms.

In no event shall Kallos AI be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages exceeding the amount you paid in the last 12 months

12. Indemnification

You agree to indemnify and hold harmless Kallos AI from any claims, damages, or expenses arising from:

• Your use of the Service
• Your content or publishing activities
• Your violation of these Terms
• Your violation of third-party rights (copyright, trademark, privacy)

13. Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms or our Acceptable Use Policy
• Engage in fraudulent or abusive behavior
• Fail to pay subscription fees
• Use the Service in a way that harms other users or our platform

Upon termination, you will lose access to the Service and your data (subject to our 30-day deletion retention period).

14. Changes to These Terms

We may update these Terms periodically. Significant changes will be communicated via email with at least 30 days notice. Continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States. Any disputes will be resolved in the courts of the State of Delaware, United States.
